TUTTO SULLA REGOLARIZZAZIONE Nelle more della definizione del procedimento di emersione dei rapporti di lavoro irregolari, lo straniero non può essere espulso, tranne coloro che non sono ammessi alla regolarizzazione. Vengono sospesi inoltre i procedimenti penali e amministrativi nei confronti del datore di lavoro e del lavoratore. La dichiarazione di emersione si potrà presentare nel mese di settembre, e a partire da ottobre i datori di lavoro e i lavoratori verranno convocati in ordine cronologico dell’invio delle dichiarazioni per la firma del contratto di soggiorno e la richiesta del permesso di soggiorno. Ricordiamo che tutte le informazioni riguardo la regolarizzazione si possono consultare sul sito www.cinformi.it. While awaiting final judgement on the situation with regard to non-regularized employment, the foreign person working here may not be expelled, except in the case of those who are prevented from being candidates for regularization. Any criminal or administrative law proceedings are also suspended in relation both to employer and employee. A declaration of ‘emergence’ may be presented in September, and from October employees and employers will be called in chronological order from the submission of the declaration to sign a resident contract and apply for a residence permit. IN VIGORE LA LEGGE SICUREZZA Dall’8 agosto scorso è in vigore la legge n. 94/2009 in materia di sicurezza che inasprisce le norme sulla condizione giuridica degli stranieri e sulle modalità di ingresso e soggiorno degli immigrati. Tra le norme ricordiamo il reato di clandestinità punito, oltre con l’espulsione, con un’ammenda che varia tra 5 e 10mila euro per chi entra o si trattiene irregolarmente sul territorio nazionale. Per l’applicazione di alcune altre norme come l’accordo di integrazione, il contributo per la richiesta di rilascio o di rinnovo del permesso di soggiorno e l’esame di italiano per il permesso CE è necessario attendere un apposito regolamento. The new security law, (law number 94/2009), came into force on 8th August. This law further tightens the laws on the legal status and position of foreigners on matters of the entry of immigrants into the country and their subsequent rights to stay. We remind you that the laws on the matter include the crime of ‘clandestine entry’, which can be punished not only by expulsion but also a fine of five to ten thousand euro where there has been illegal entry or irregular continuance in Italy. For the application of other legislation, such as that regarding the integration agreement, the contribution for applications for the issue or renewal of residence permits and the Italian language exam for the EEC permit, we shall have to wait further for any implementing regulations. 08/08/2009

REGISTRAZIONE NASCITA FIGLIO Per le dichiarazioni di nascita all’anagrafe e di riconoscimento di un figlio di genitori irregolari non è necessario presentare il permesso di soggiorno, al contrario di quanto si temeva i giorni scorsi. Lo chiarisce il ministero dell’Interno con una recente circolare. I documenti di soggiorno non vengono richiesti nemmeno per accedere alle cure sanitarie e alle prestazioni scolastiche obbligatorie. E’ necessario però esibire i documenti di soggiorno agli uffici della pubblica amministrazione per il rilascio di licenze, autorizzazioni, iscrizioni ed altri provvedimenti di interesse dello straniero. Parents that have not had their own positions regularised with the Italian authorities and who wish to declare the birth of a child and to recognise their parenthood do not need to present a residence permit, as had been feared over the last few days. The Interior ministry has made this clear with a recent circular. The residence documents are also not required in order to gain access to health care and compulsory schooling. It is however a requirement to exhibit residence documents to the authorities when applying for the issue of licences, governmental authorisations, subscriptions and registrations and such other governmental orders of interest to the foreigner. 11/08/2009

CORSO PER IMPRENDITORI IMMIGRATI Sono aperte le iscrizioni a Trento ad un corso gratuito per diventare imprenditori nell’ambito del commercio o dei servizi. Destinato a 12 immigrati non comunitari senza lavoro, il corso è organizzato da Delta Servizi srl di Trento. La durata delle lezioni è di 292 ore e prevede un impegno a tempo pieno per 5 giorni in settimana. La scheda di adesione deve pervenire a Delta servizi in via Bassa, numero 42 a Trento entro il 20 agosto. Le selezioni verranno effettuate il giorno 28 agosto. Ulteriori informazioni si possono trovare sul sito www.deltaformazione.it. Applications can now be made for enrolment on a free course in Trento for those wishing to become entrepreneurs in trade or services. The course will be provided for 12 non EEC immigrants that are currently out of work, and is being organised by Delta Servizi srl of Trento. There will be 292 hours of lectures involving full time study five days a week. The application form must reach Delta services in via Bassa, 42,Trento by 20th August.
